Legal obligations and risks for employers continue to evolve in relation to the COVID-19 pandemic. For essential service providers and others who have been able to stay up and running during the pandemic, maintaining workplace safety is crucial. This session focused on the latest guidance from medical authorities, and best practices with respect to maintaining workplace safety during a pandemic, including telework options, social distancing protocols, quarantine protocols, and special protective equipment and medical testing for employees. Panelists discussed the best response to learning about COVID-19 exposure or a positive COVID-19 test in your workplace. They also discussed how the Americans with Disabilities Act (“ADA”), which protects the confidentiality of employee health information, applies in these situations.
