With a technical background as a former IT consultant, Barber Boone has over 15 years of experience in handling matters with complex e-discovery issues. He has served as lead counsel or co-counsel on various large matters where complicated document issues persist throughout the litigation, such as trade secret, false advertising, and environmental litigation. He is also experienced in advising clients responding to cybersecurity issues, especially relating to ransomware attacks. In addition to the commercial litigation and cybersecurity issues, he also defends insurance companies and third party administrators in bad faith litigation.
He is frequently called upon to assist with complex document issues. He is known for his ability to parse through large volumes of collected documents to identify documents for review and eventual production.
Barber is co-author of the Electronic Discovery chapter of the Mississippi Civil Procedure treatise. He is AV-rated by Martindale-Hubbell and has been recognized by Mid-South Super Lawyers® for his work. He was named to the Top 50 Under 40 by the Mississippi Business Journal in 2015.
He holds a B.S.E. degree in Mechanical Engineering from Vanderbilt University. Immediately after Vanderbilt, Barber worked for Accenture designing and coding large custom software for his clients. After several years at Accenture, he obtained his J.D. from the University of Mississippi. Barber is admitted to practice in Mississippi and Tennessee, as well as all districts of the Mississippi U.S. District Court and the Fifth Circuit and District of Columbia U.S. Court of Appeals.
Experience
- Currently represents a third-party reviewer in allegations of bad faith based on an employee health plan covered by ERISA.
- Currently represents an insurance company in litigation alleging theft of a trade secret relating to a new method of sales.
- Represented SkyHawke Technologies, LLC, a manufacturer of distance measuring devices for golf, in two lawsuits alleging one of its competitors was falsely advertising its products in detriment to SkyHawke’s sales. The parties were able to reach an amicable agreement just before trial.
- Resolved claims against a third-party administrator in which the plaintiff claimed the third-party administrator acted in bad faith in the administration of a workers compensation claim.
- Recently assisted a client in responding to a ransomware attack in which the analysis of whether information protected by HIPAA had been affected.
- Represented a large construction equipment supplier in a data breach and trade secrets case pending in federal courts in two different states. The parties were able to reach a mutually agreeable settlement.
- Consulted with large private companies and government agencies in developing software and improving business processes to align with companies’ and agencies’ growth, as a consultant for Accenture.
